Military Commissions Act upheld by Court
It is really quite distressing that a Federal Judge -- a Clinton appointee no less -- has now upheld the Constitutionality of the suspension of Habeas Corpus in the Military Commissions Act. As I understand it, the Judge ruled that, while Congress can't suspend Habeas, it can deny the Courts the jurisdiction to recognize it. Without jurisdiction by the Courts, it's hard to see what the writ of Habeas Corpus means.
