Sweeping the spying issue under the table

Raw Story is reporting that some Senators are talking about proposing a Constitutional Amendment to limit the President's wartime powers:

New York -- As Capitol Hill prepares to battle the White House over George W. Bush's expanding war powers, moderate Senators on both sides of the aisle are quietly considering a range of options that would attempt at the very least to delineate the President's authority, if not roll it back. Bush's claims of wartime license are so great-the White House and Justice Department have argued that the Commander in Chief's pursuit of national security cannot be constrained by any laws passed by Congress, even when he is acting against U.S. citizens-that some Senators are considering a constitutional amendment to limit his powers, Massimo Calabresi and Timothy J. Burger report in MONDAY's TIME.

Frankly, I think this is a horrible idea. You don't deal with a president who breaks the law by agreeing that he has a right to break the law. We all know the amendment would get NOWHERE. It wouldn't go anywhere even if the Dems retook Congress. It's dead in the water. But, introducing an amendment would effectively confirm Bush's claim that he has the Constitutional right to ignore Congress during wartime (which is, of course, all the time under this prez's definition). If this is the way our senators are going to try to sweep the issue under the table, it's a terrible, horrible, disgusting decision.
