Libby case on the rocks?

It's beginning to look to me as though the Fitzgerald case against Libby is going to be thrown out of court. Somehow or other, Libby has gotten the Judge to agree that he needs to introduce all kinds of classified information in order to prove that his brain was so overwhelmed by details that he certianly might have forgotten about the outing of Plame. Naturally, the government is going to refuse to de-classify that stuff, and consequently, the trial will have to be thrown out. Pretty neat trick, isn't it?

WASHINGTON (AP) - Vice President Dick Cheney's former chief of staff intends to load up his criminal trial with information about nine national security matters, the names of foreign leaders and details about various terrorist groups, say court filings in the Valerie Plame leak case.

The papers filed this week hint at what has been taking place behind closed doors as Special Counsel Patrick Fitzgerald tries to limit the amount of classified data that I. Lewis "Scooter" Libby is permitted to use at his trial in January.
