Article II Powers
The other day, the Senate Judiciary Committee asked Alberto Gonzales whether listening in on calls between two Americans without a warrant was within the President's Article II powers. Gonzales answered in the affirmative.
Here's the question I wish they would ask: Is it within the President's Article II powers during wartime to cancel a presidential election because he deems it in the national security interest to remain as president until the completion of the war?
I doubt Gonzales would answer, but I'm not kidding about the question. It seems to me that is the inescapable conclusion one reaches using the President's Article II logic.
And, Bush is pushing this logic very hard right now, at every opportunity ...
