Avoiding the Courts

Once again, just as a case challenging the Guantanamo detentions is about to go to court, the Bush administration tries to pre-empt any court decision by removing the detainees, a group of Chinese. In this case, they're being sent to Albania, where who knows what will happen to them. Bush is now arguing that the case is moot, since the detainees are no longer slotted to stay at Guantanamo. If he's successful, this will prevent the court from ruling and leave standing the current practice of indefinite detention without rights of any kind.

These guys were detained for four years without trial and are now considered innocent by the U.S. They were being held because the government feared they would be mis-treated if they were returned to China.

At least this proves that Bush still fears a head-on collision with the courts.
